Vessel is being sold AS-IS, WHERE-IS, WITH ALL HER FAULTS, and without any warranties of condition whatsoever, expressed or implied, including, without limitation, any warranty of seaworthiness, merchantability, or fitness for particular purpose. The vessel shall be sold only for scrap, restoration, salvage, or another use that will remove the vessel from state waters. Vessel may be sold only to a person or entity having a business license issued under RCW 19.02.070 that can demonstrate to seller’s satisfaction and buyer’s capability and intent to scrap, restore, salvage, or apply the vessel to another use that will remove the vessel from state waters based on factors that may include the buyer’s facilities, resources, documented intent, and relevant history. Prior to sale the buyer must procure marine insurance upon the vessel satisfying the requirements of RCW 79.100.170.
